RELEASE, WAIVER, AND CONSENT AGREEMENT FOR MEMBERS AND NON-MEMBER PARTICIPANTS
This document is a legal agreement affecting your rights and responsibilities. Please read it carefully before signing. The signatory accepts its terms freely and without reservation.
Understanding of Risks
I understand that martial arts (Judo / Brazilian Jiu-Jitsu / Wrestling / Grappling / Martial Arts in General) involve violent and sudden movements and physical contact between instructors and participants. This includes but is not limited to throws, takedowns, joint locks, chokes, punches, strikes, etc. I acknowledge that the training program at Washington Judo Academy also incorporates various related activities, including but not limited to acrobatics, stretching, strength training, and endurance training.
I understand and acknowledge that despite precautions taken by Washington Judo Academy, martial arts and related activities pose an inherent risk of serious injury, permanent disability, contraction of illness and/or disease, or even death caused by a collision, fall, or cardiovascular stress.
I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time.
Assumption of Risks
I knowingly and voluntarily assume any and all of the inherent dangers and risks associated with martial arts instruction and training, and related activities. I understand the nature of these activities and confirm that I am physically fit and qualified to participate in them. I have the right to ask questions about any risk and to refuse to participate.
Medical Condition and Fitness
I certify that I am in good health and physical condition, and do not have any communicable illnesses, conditions, or diseases. I certify that I will not participate in any activities if I am not in good health and physical condition.
Release of Liability
In consideration for being permitted by Washington Judo Academy to utilize its facilities, participate in events, and receive instruction, I, individually on behalf of myself and anyone claiming by or through myself or my parent or guardian, hereby agree to hold harmless, release, indemnify, forever discharge and covenant not to sue Washington Judo Academy, its officers, directors, volunteers, employees, instructors, agents, and authorized representatives from any and all responsibility or liability, claim or loss, including loss of property, damage, personal injury, illness, death, or expenses, including but not limited to attorney's fees and litigation expenses, incurred by myself or my parent or guardian, and arising from my execution of this agreement, participation in any program or event offered by or taking place on the premises of Washington Judo Academy, including but not limited to any injury, transmittable diseases, or damage caused by the negligence of Washington Judo Academy, its instructors, other participants, members, students, agents, volunteers, employees, operators, or authorized representatives.
Code of Conduct
I agree to uphold a code of conduct, treating all participants and staff with respect and refraining from interfering with class activities.
Right to Decline Participation or Cancel Membership
Washington Judo Academy reserves the right to decline participation or cancel memberships for reasons not prohibited by law, refunding applicable prepaid fees. I acknowledge that participation in some classes and activities requires an additional skill assessment. The decision to allow participation will be at the sole discretion of the respective instructor.
Membership Cancellation
Once membership payments are initiated, members must email a written notice to info@wajudo.com at least 30 days before the next billing date to cancel membership payments. If the cancellation notice is not received within this timeframe, the member's account will be charged for the next billing cycle. Non-usage of the academy's facilities does not exempt from paying outstanding balances. Refunds for periods of non-usage are not provided.
Upon re-initiating membership payments after cancellation, a registration fee will apply, and the new membership fee will be charged at the current rate.
Release and Consent for the use of Photo and Video Recordings
I grant Washington Judo Academy permission to use photographs and videos of classes and events, including me and/or my minor child, for promotional or educational purposes without compensation to me.
Agreement Scope and Severability
I understand and agree that this agreement is intended to be as broad and inclusive as is permitted by the law of Washington state, and any unenforceable portions do not affect the remaining terms.
Litigation and Legal Expense Coverage
If any litigation is necessary to enforce the terms and conditions of this Agreement, the undersigned agrees to indemnify Washington Judo Academy for all of its reasonable and necessary legal fees, costs, and expenses associated with the litigation.
Signature and Agreement to Participate
I HAVE READ THE ABOVE WARNING, RELEASE, WAIVER, AND CONSENT AGREEMENT, AND UNDERSTAND THAT I GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND KNOWING THIS, SIGN IT VOLUNTARILY.
I AGREE TO PARTICIPATE KNOWING THE RISK AND CONDITIONS INVOLVED AND DO SO ENTIRELY OF MY OWN FREE WILL.
I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENT/GUARDIAN AS EVIDENCED BY THEIR SIGNATURE BELOW.
